1. How we protect your data

General information

The page provides an easy-to-navigate overview of what happens to your personal data when you visit our website. “Personal data” comprises all data that can be used to personally identify you. The following Privacy Policy provides detailed information about how your data is protected.

Recording data on this website

Who is responsible for recording data on this website (i.e. the “controller”)?

Data on this site is processed by the website’s operator. Its contact details can be found in the “Legal” section of this website.

How do we record your data?

We collect your data whenever you share it with us – for example, when you enter information about yourself into our contact form.

Some data is also recorded by our IT systems when you visit our website. This may be done automatically or after you have given your consent. This data is, for the most part, technical information (e.g. web browser, operating system, the exact time our website was accessed). It is recorded automatically as soon as you access our website.

What do we use your data for?

Some of the information is collected to ensure that our website runs smoothly. Other kinds of data may be used to analyse the way you use our site.

What rights do you have regarding your personal data?

You have the right to receive information whenever you wish about where we got your stored personal data from, who received it and what it has been used for. This information must be provided free of charge. You also have the right to demand that your data be corrected or deleted. If you have given your consent to your data being processed, then you have the right to withdraw this consent for all future processing activities at any time. Moreover, under certain circumstances, you have the right to demand that the processing of your data be restricted. Furthermore, you have the right to lodge a complaint with a data protection supervisory agency.

Please do not hesitate to contact us if you have a question about this or any other data protection related issues. Our contact details can be found in the “Legal” section of this website.

Analysis tools & third-party tools

Your browsing behaviour may be statistically analysed when your visit our website. Such analyses are primarily carried out using cookies and so-called analysis programs.

More detailed information about these analysis programs can be found below.

2. General & mandatory information

Data protection

The operators of this website take the protection of your personal data very seriously. We always treat your personal data as confidential and comply with both statutory data protection regulations and the provisions set out in this Privacy Policy.

Different kinds of personal data are collected whenever you use this website. Personal data is any type of data that can be used to personally identify you. This Privacy Policy explains which data we collect and what we use it for. It also explains how and for which purpose this is done.

We would like to point out here that security breaches may occur when data is transmitted via the internet (e.g. when an email is sent). It is not possible to completely protect data from being accessed by third parties.

Legal person responsible for processing data (GDPR: the “controller”)

The legal person responsible for processing data on this website (the controller) is:

Dr. M. Newzella GmbH
Amtshofweg 10
48317 Drensteinfurt
Germany

Tel.: +49 (0) 2508 9942-0
Email: info@newzella.com

A controller is a natural or legal person who is solely or jointly responsible for deciding how and why personal data (e.g. names, email addresses etc) is processed.

Your right to withdraw your consent to your data being processed

Data can be processed in a wide variety of ways and many of these processes are only permitted if you have given prior consent. You can withdraw your consent whenever you wish by simply sending us an email to this effect. The lawfulness of the processes used to collect your data before you withdrew your consent remain unaffected by this.

Your right to object to the collection of data on grounds relating to a particular situation / for direct marketing purposes (Art. 21 GDPR)

YOU HAVE THE RIGHT TO OBJECT, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA IF THE DATA IS PROCESSED BASED ON POINT (E) OR (F) OF ARTICLE 6(1) GDPR. THIS ALSO APPLIES TO ANY PROFILING BASED ON THESE PROVISIONS. PLEASE CONSULT THIS PRIVACY POLICY TO DETERMINE THE LEGAL BASIS, ON WHICH DATA IS PROCESSED HERE. IF YOU LODGE AN OBJECTION, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA AFFECTED, UNLESS WE ARE ABLE TO DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING OF YOUR DATA THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS OR FOR THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 PARA. 1 GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING. THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21 PARA. 2 GDPR).

Your right to lodge a complaint with a supervisory agency

In the event of a violation of the GDPR, data subjects have the right to lodge a complaint with a supervisory agency, in particular in the member state where they usually reside, work or where the alleged violation occurred. Data subjects have the right to lodge a complaint without prejudice to any other administrative or judicial remedy.

Your right to data portability

You have the right to demand that we hand over any data – which we have automatically processed based on your consent or to fulfil a contract – to you or to a third party in a commonly used and machine-readable format. If you exercise your right to have your data transmitted directly to another controller, we shall do this where technically feasible.

SSL and/or TLS encryption

This website uses SSL and/or TLS encryption for security reasons. It is also used to protect the transmission of confidential content – such as orders or inquiries – that you submit to us, i.e. to the website operator. You know you have an encrypted connection when the website address switches from “http://” to “https://” and a padlock icon appears in the browser bar.

If the SSL or TLS encryption is activated, then the data you transmit to us cannot be read by third parties.

Your right to access, rectification & erasure

You have the right – within the scope of applicable statutory provisions – to obtain information at any time about which data we have stored about your person, where we got this information from, who received it and what purposes your data has been processed for. You may also have the right to have your data rectified or erased. Please do not hesitate to contact us if you have a question about this or any other data protection related issues. Our contact details can be found in the “Legal” section of this website.

Your right to restriction of processing

You have the right to contact us at any time to restrict the processing of your personal data. Our contact details can be found in the “Legal” section of this website. The right to obtain restriction of processing applies in the following cases:

  • If you contest the accuracy of your personal data stored by us, we normally need some time to verify this. You have the right to request the restriction of the processing of your personal data while we verify the accuracy of your data.
  • If the processing of your personal data was/is unlawful, you have the option to request the restriction of the use of your personal data instead of requesting its erasure.
  • If we no longer need your personal data but you need it for the establishment, exercise or defence of legal claims, then you have the right to request the restriction of the use of your personal data instead of requesting its erasure.
  • If you have lodged an objection pursuant to Art. 21 Para. 1 GDPR, then your rights and our rights must first be weighed up. You have the right to request the restriction of the processing of your personal data during this verification process.

If you have restricted the processing of your personal data, this data may – with the exception of storage – only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

3. How data is recorded on this website

Cookies

Our website uses so-called “cookies.” Cookies are small text files and do not damage your device. They are either stored temporarily on your device for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted when you leave our website. Persistent cookies remain stored on your device until you delete them yourself or they are automatically erased by your web browser.

In some cases, third-party cookies may be stored on your device when you enter our site. These cookies enable us or you to use a particular service offered by the third party (e.g. for processing payment).

Cookies can have a variety of functions. Some website services, for example, cannot function without cookie technology (e.g. the shopping cart function or displaying videos). Other cookies may be needed to analyse user behaviour or to display advertising.

Cookies that are needed to carry out electronic communication processes (strictly necessary cookies) or to provide certain functions you wish to use (preferences cookies, e.g. the shopping cart function) or to optimise our website (statistics cookies) are stored based on Art. 6 Para. 1(f) GDPR, unless a different legal basis is cited. The operator of the website has a legitimate interest in storing cookies to ensure that its services can be provided without technical errors and in the best possible manner. If you are asked to give your consent to cookies being stored, then these particular cookies shall be stored solely on the basis of your consent (Art. 6 Para. 1(a) GDPR). You may withdraw your consent at any time.

You can change your browser’s settings so that you are notified whenever cookies are placed on your device. These settings enable you to accept cookies on a case-by-case basis, for specific cases or to stop them altogether. Moreover, you can activate the delete function so that the cookies are automatically deleted when you close your browser. Some of the website’s functions may be restricted if you disable the cookies.

A dedicated section will be included in this Privacy Policy to notify you if we use cookies from third parties or for analytical purposes. If required, we will also ask you for your consent.

Server log files

The provider of this website automatically collects and stores information in so-called server log files. These are automatically transmitted to us by your browser and include the following information:

  • the type and version of browser used
  • the operating system being used
  • the referrer URL
  • the hostname of the computer accessing the site
  • the time of the server inquiry and
  • the IP address.

This data is not added to other sources of data.

This data is recorded on the basis of Art. 6 Para. 1(f) GDPR. The operator of the website has a legitimate interest in ensuring that its website can be provided without technical errors and optimised where necessary – server log files must be recorded to be able to do this.

Contact form

If you submit inquiries to us via our contact form, then the information and contact details provided in the contact form are stored by us so that we can process your inquiry and, where necessary, ask further questions. We will not share this information without your consent.

This data is processed based on Art. 6 Para. 1(b) GDPR if your inquiry is related to the fulfilment of a contract or to carry out pre-contractual measures. In all other cases, the processing is based either on our legitimate interest in effectively processing requests addressed to us (Art. 6 Para. 1(f) GDPR) or on your consent (Art. 6 Para. 1(a) GDPR) if this has been requested.

The information you have entered into the contact form shall remain with us until you ask us to erase the data, you withdraw your consent to your data being stored or if the purpose for which the information is stored no longer applies (e.g. after we have finished processing your inquiry). Statutory provisions – in particular mandatory data retention periods – remain unaffected by this.

Requests made by email, telephone or fax

If you contact us by email, telephone or fax, then your inquiry – and all personal data related to this (name, inquiry) – are stored and processed by us so that we can handle your request.

The information you have passed on to us as part of your inquiry shall remain with us until you ask us to erase the data, you withdraw your consent to your data being stored or if the purpose for which the information is stored no longer applies (e.g. after we have finished processing your inquiry). Statutory provisions – in particular mandatory data retention periods – remain unaffected by this.

4. Analysis tools & advertising

Google Analytics

This website uses the web analytics service, Google Analytics. This service is provided by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses so-called cookies. Cookies are text files that are stored on your computer and enable the website to analyse how you use this site. The information generated by the cookie about your use of this website is usually transmitted to and stored on a Google server in the United States.

The storage of Google Analytics cookies and the use of this analysis tool are based on Art. 6 Para. 1(f) GDPR. The operator of this website has a legitimate interest in analysing user behaviour to optimise both its website services and its advertising activities. If your consent has been requested to do this (e.g. consent to store cookies), then the processing shall take place solely on the basis of Art. 6 Para. 1(a) GDPR). You may withdraw your consent at any time.

IP anonymisation

IP anonymisation has been activated on this website. As a result, your IP address is shortened by Google within the member states of the European Union or in other states that have ratified the Convention on the European Economic Area before it is transmitted to the United States. Full IP addresses are only transmitted to one of Google’s servers in the United States and shortened there in exceptional cases. Google uses this information on behalf of the operator of this website to analyse your use of this site in order to compile reports on website activity and provide the website operator with other services relating to website and internet usage. Google does not add the IP address transmitted to Google Analytics by your browser to its other data.

Browser plug-in

You can block these cookies by changing the settings of your browser software. Please note, however, that some functions on this website may not be fully accessible if you do this. You can also prevent Google from using the cookie to collect data about the way you use our website (including your IP address) and from processing this data by downloading and installing a browser plug-in. You can access this plug-in by clicking on the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

Objection to the recording of data

You can prevent Google Analytics collecting your data by clicking on the following link. An opt-out cookie will be placed on your device when you click on the link so that your data will no longer be collected when you visit our website in the future: Deactivate Google Analytics.

Further information about how Google Analytics handles user data can be found in Google’s Data Privacy Declaration at: https://support.google.com/analytics/answer/6004245?hl=en.

Commissioned data processing

We have concluded a data processing agreement with Google and implement the stringent provisions of the German data protection authorities in their entirety when using Google Analytics.

Data retention

User-level and event-level data associated with cookies, user-identifiers (e.g. User-ID) and advertising identifiers (e.g. DoubleClick cookies, Android’s advertising ID) that has been stored by Google is anonymised or deleted after 26 months. Further details can be found by clicking on the following link: https://support.google.com/analytics/answer/7667196?hl=en

5. Plug-ins & tools

Google Maps

This website uses the mapping service, Google Maps, via an API. This service is provided by Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Your IP address must be stored so that the Google Maps features can be used. This information is usually transmitted to and stored on a Google server in the United States. The operator of this website has no control over the transfer of this data.

We use Google Maps to make our online content more visually appealing as well as to make it easier to find the locations mentioned on our website. This constitutes a legitimate interest as defined in Art. 6 Para. 1(f) GDPR. If your consent has been requested to do this, then data shall be processed solely on the basis of Art. 6 Para. 1(a) GDPR). You may withdraw your consent at any time.

Further information about how user data is handled can be found in Google’s Data Privacy Declaration at: https://policies.google.com/privacy?hl=en.

6. Our own services

How we process applicant data

We offer you the opportunity to send us job applications (e.g. by email, post or submitting our online job application form). The following paragraphs provide information about the scope, purpose and use of the personal data that we collect about you as part of the application process. We hereby confirm that your data is collected, processed and used in accordance with data protection law and all other statutory provisions and that it is treated as strictly confidential at all times.

Scope and purpose of the collection of data

When you submit a job application to us, we process all personal data related to this (e.g. contact and communication details, application documents, notes taken during job interviews etc) if they are needed to make hiring decisions. The legal grounds for this are Art. 26 BDSG-neu [new Federal Data Protection Act] in acc. with German law (initiating possible employment), Art. 6 Para. 1(b) GDPR (general initiation of a contract) and – if you have given us your consent – Art. 6 Para. 1(a) GDPR. You may withdraw your consent at any time. Your personal data is only shared with people in our company, who are involved in processing your job application.

If your job application is successful, then the data you submitted is stored in our data processing systems – on the basis of Art. 26 BDSG-neu [new Federal Data Protection Act] and Art. 6 Para. 1(b) GDPR – in order to implement the employment procedure.

Data retention period

If we are unable to make you a job offer, you reject a job offer or you withdraw your application, then we reserve the right to retain the data you submitted for the purposes of our legitimate interests (Art. 6 Para. 1(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). Following this period, the data is then deleted and hard copies of the application documents destroyed. The data is stored, in particular, as evidence in the event of a legal dispute. If it is evident that the data will be required after the six-month period ends (e.g. due to an impending or pending legal dispute), then deletion will not take place until the reason for extending the storage period no longer applies.

Data may also be stored for longer if you have given your consent (Art. 6 Para. 1(a) GDPR) or if deletion is not permitted due to statutory data retention requirements.

Admission to the applicant pool

If we do not make you a job offer, you may be able to join our applicant pool. If you are added to this pool, then all the documents and information from your initial application process will be transferred to the applicant pool so that we can contact you if a suitable vacancy arises.

Admission to the applicant pool is based solely on your express consent (Art. 6 Para. 1(a) GDPR). Consent is given purely on a voluntary basis and is not related in any way to your ongoing application procedure. You can withdraw your consent at any time. If you choose to do this, then your data will be irrevocably deleted from our applicant pool, provided we are not obliged to store the data for statutory retention reasons.

Your data will be irrevocably deleted from the applicant pool no later than two years after the date you give your consent.
